Terms of Service

By accessing or using Mulabee, you agree to comply with and be bound by these Terms of Service in their entirety. If you do not agree to any part of these terms, please do not use our service.

1. Description of Service

Mulabee is a Software-as-a-Service (SaaS) platform that allows service businesses to create public booking pages and manage appointments with their clients. The service is accessible via mulabee.com.

Mulabee operates solely as a technology provider. The registered business owner (the "Owner") is fully responsible for their services, pricing, availability, and the direct relationship with their end clients.

2. Eligibility and Registration

To use Mulabee as a Business Owner, you must:

  • Be at least 18 years of age.
  • Provide accurate, truthful, and up-to-date information during registration.
  • Maintain the security and confidentiality of your account credentials and passwords.
  • Notify us immediately of any unauthorized use of your account.

Mulabee reserves the right to refuse service, suspend, or terminate accounts that violate these terms or are utilized for fraudulent or illegal activities.

3. Acceptable Use Policy

By using Mulabee, you explicitly agree NOT to:

  • Use the service for any illegal activities or to violate the rights of third parties.
  • Publish false, misleading, defamatory, offensive, or inappropriate content.
  • Attempt to access the accounts or data of other users without authorization.
  • Reverse engineer, decompile, or attempt to extract the source code of the platform.
  • Overload our infrastructure or servers with automated tools (scraping, bots, DDoS attacks).
  • Use the service to distribute spam or unsolicited communications.
  • Register fictitious businesses or accounts for fraudulent purposes.

4. Accounts and Subscriptions

Mulabee may offer free and paid subscription plans. The specific features, limits, and pricing of each plan are detailed on the pricing page of mulabee.com.

Subscription payments are processed securely through Stripe (PCI-DSS Level 1). Mulabee does not store or process credit card numbers on our servers.

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date. You can cancel your subscription at any time directly from your account dashboard.

5. User Content

You are solely responsible for all content, images, services, prices, and branding you upload to Mulabee. By posting content, you guarantee that:

  • You hold the necessary rights and permissions to publish and distribute it.
  • It does not infringe on copyrights, trademarks, or proprietary rights of third parties.
  • It does not contain illegal, violent, or sexually explicit material.

Mulabee reserves the right to remove any content that violates these terms without prior notice.

6. Client Data and Bookings

Data entered by clients using your public booking page (names, phone numbers, emails, appointments) belongs to the Business Owner. Mulabee stores and processes this data on your behalf as a data processor.

You are solely responsible for obtaining the necessary consent from your clients to collect and process their personal data, and for complying with the local data protection laws applicable in your jurisdiction.

7. Service Uptime and Availability

Mulabee strives to maintain a 99.9% service availability. However, we do not guarantee uninterrupted service. Disruptions may occur due to:

  • Scheduled platform maintenance (announced in advance whenever possible).
  • Outages or failures of our upstream infrastructure providers (Neon, Cloudinary, etc.).
  • Force majeure events.

We are not liable for any losses or damages arising from platform downtime or service interruptions outside of our control.

8. Intellectual Property

All code, design, logos, visual style, assets, and branding of Mulabee are the exclusive property of Mulabee and are protected under international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without express written consent.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable license to access and use the platform during your subscription term.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Mulabee shall not be held liable for:

  • Loss of profits, business opportunities, or revenue resulting from the use or inability to use the service.
  • Indirect, incidental, special, or consequential damages.
  • Actions, omissions, or service failures of third-party platforms (Stripe, Google, Apple, Facebook, etc.).
  • Loss of data caused by user errors or internet connection issues.

Mulabee's maximum aggregate liability for any claim shall not exceed the amount actually paid by you to Mulabee during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mulabee, its officers, employees, and suppliers from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the platform, violation of these terms, or infringement of third-party rights.

11. Cancellation and Termination

By the User: You can delete your account at any time directly from the settings in your dashboard. Upon deletion, your public booking page will become unavailable, and your data will be handled in accordance with our Privacy Policy.

By Mulabee: We reserve the right to suspend or terminate your account if you violate these terms, without prior notice in severe cases. For minor violations, we will notify you at least seven (7) days in advance to allow rectification.

12. Amendments to These Terms

We may update these Terms of Service from time to time. We will notify you via email at least thirty (30) days before any material changes take effect. Continued use of the platform after such notice constitutes your acceptance of the updated terms.

13. Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws of the jurisdiction of the Owner. In the event of a dispute, the parties agree to seek a resolution in good faith via direct negotiation before resorting to formal legal action.
